Depending on the state where you are located, and the local landlord laws, your notification details may be a bit different.

There are three different types of eviction notices that you may receive, depending on your situation.

  • Pay Rent or Quit Notice – if you are behind on your rent, you will likely receive this notification. Your landlord will give you a specific period of time to pay to pay your owed rent or they will evict you. The time period will depend on the landlord, and the state’s laws. You may have as little as 3-5 days.   • Cure or Quit Notices – if you violate a term of your rental agreement, you may receive this type of notice. “Cure” refers to curing a violation of a term of your contract. An example of violating a term is sneaking your dog into your apartment, even though you were rented the apartment on the understanding that no pets were allowed. Your landlord will give you a specific amount of time to correct this contract violation. If you do not, he or she may evict you.
  • Unconditional Quit Notices – if you receive this notice, you have no choice but to be evicted. This is a serious notice that is not usually provided to you first. First, you will either receive a “Pay Rent or Quit Notice”, or a “Cure or Quit Notice.” If, and only if, you have not followed those notices, or there are multiple issues between you and your landlord, will you receive this type of notice. Even if some states allow your landlord to present you with this notice before a “Pay Rent or Quit Notice” or a “Cure or Quit Notice,” most landlords will present those notices to you first, because rent needs to paid and apartments are better when filled.

You don’t need to worry. Your landlord will not move your stuff for you or throw it out. If they do anything at all, they will, under the supervision of a lawyer or law enforcement official, move your stuff to a secure storage location and change the locks on your rental. If you are evicted, you should pick up your stuff as soon as possible.
